CBD (Cannabidiol) is such a hot topic of interest now, and I’ve been seeing a lot of questions around the legality of CBD, so I wanted to tackle this question.
First of all, based on our last blog post, we know that CBD is is from the marijuana plant, so what about just the legality of marijuana or cannabis? Well currently, and surprisingly marijuana is legal in 10 states plus the District of Columbia. In alphabetical order we’ve got Alaska, California, Colorado, Maine, Massachusetts, Michigan, Nevada, Oregon, Vermont, and last but not least Washington state. Oh, and of oddly enough, marijuana is legal in Washington D.C.
You’ve also got quite a few states who have recently passed medical marijuana laws, but again this really doesn’t mean marijuana is legal like the other states. Also, at the end of the day - marijuana is not actually legal in the United States, it’s very much still illegal as federal law dictates. However, in most of the states in which it’s legal - more than likely a person in possession of marijuana would be okay - but hey this isn’t a legal advice blog - we focus on caffeine and supplements!
Okay, so we’ve generally established the legality of marijuana, so next let’s focus on the meat of this topic.
What about CBD?
Well cannabinoid is extracted from marijuana or cannabis, and like I’ve written before, It’s actually a more preferred way to get the health benefits of marijuana without the negative side effects that’s associated with marijuana usage - one of those course being possible jail or prison time.
So here’s the thing - CBD is kind of a gray area right now, but the good news is that for the most part it’s very much okay to have and use CBD oil!
The federal government exempts certain parts of the hemp plant to be used in CBD oil, so unlike THC (tetrahydrocannabinol) which is the psychoactive (gives you the high feeling) ingredient in marijuana (cannabis sativa) – CBD is a compound that has a super-similar chemical make-up (C₂₁H₃₀O₂) to THC but without the effects of the psychoactive or the even the adverse effects of the psychoactive (THC).
As such, CBD oil can currently be shipped to any of the 50 states, and ordering it online has never been easier.
Here’s a general rule of thumb (and while this isn’t legal advice), if you’re buying in small quantities for personal and home use - you should be absolutely fine and shouldn’t sweat it.
